Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you (“you,” “Customer,” or “User”) and Robert Dayton, an individual doing business as LoyalServe (“LoyalServe,” “we,” “us,” or “our”), the sole owner and operator of loyalserve.com and the LoyalServe software service (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility & accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate registration information and to keep it current. You are responsible for all activity under your account and for safeguarding your credentials. Notify us immediately at loyalpuppy@gmail.com of any unauthorized use.
2. Subscription, fees, and payment
- Fees are described on the Service or in a written order. Unless stated otherwise, fees are billed in advance, are non-refundable, and exclude taxes (which you are responsible for).
- You authorize us and our payment processor to charge your designated payment method for all amounts due, including recurring subscription fees.
- Late or unpaid amounts may incur interest at the lower of 1.5% per month or the maximum permitted by law, plus reasonable collection costs.
- We may change fees on at least 30 days' notice; changes take effect on your next renewal.
3. Free trials & demos
If we offer you a free trial or demo, the trial is provided “as is” and may be modified or discontinued at any time. Unless you cancel before the trial ends, your account will convert to a paid subscription at the then-current rate.
4. Acceptable use
You agree not to:
- Use the Service to violate any law, court order, or third-party right.
- Upload malware, attempt to bypass security, probe for vulnerabilities without prior written consent, or interfere with the Service or other users.
- Reverse engineer, decompile, or copy the Service except to the extent expressly permitted by law.
- Resell, sublicense, or provide the Service to third parties as a substitute for them buying it from us.
- Submit false, fraudulent, or knowingly inaccurate information into service-of-process or affidavit records.
5. Customer Data
“Customer Data” means any data, documents, photographs, GPS records, signatures, and other content you or your authorized users submit to the Service. As between you and us, you own your Customer Data. You grant us a worldwide, non-exclusive, royalty-free license to host, copy, transmit, display, process, and back up Customer Data solely to provide and improve the Service and to comply with law.
You represent and warrant that you have all rights and consents required to submit Customer Data to the Service, and that your use of the Service complies with all licensing, court, and regulatory rules applicable to your work as a process server, agency, attorney, or other professional.
6. Service-of-process records
Service-of-process records (including affidavits, attempt logs, GPS evidence, photographs, and scans) created with the Service are intended to support your evidentiary obligations to courts and clients. You are solely responsible for the accuracy and lawful collection of such records and for any sworn statements made under oath. The Service is a tool; it is not a guarantor of legal sufficiency in any jurisdiction.
7. Intellectual property
The Service, including all software, designs, text, graphics, and trademarks, is owned by Robert Dayton or his licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service during the term of your subscription and in accordance with these Terms.
8. Third-party services
The Service may integrate with third-party services (for example, payment processors, mapping providers, scanning hardware, mail providers). Your use of those services is governed by their own terms; we are not responsible for them.
9. Confidentiality
Each party will protect the other's non-public information using at least the same care it uses to protect its own confidential information, and will use such information only to perform under these Terms. This does not apply to information that is publicly available, independently developed, lawfully received from a third party, or required to be disclosed by law.
10. Suspension and termination
We may suspend or terminate your access to the Service if you breach these Terms, fail to pay fees when due, or use the Service in a way that creates risk for us or other users. You may cancel at any time; cancellation takes effect at the end of your then-current billing period. Upon termination, your right to use the Service ends. We will make Customer Data available to you for export for at least 30 days after termination, after which we may delete it consistent with our Privacy Policy and applicable law.
11. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, LoyalServe disclaims all warranties, whether express, implied, statutory, or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will meet your specific requirements.
12. Limitation of liability
To the maximum extent permitted by law, LoyalServe and Robert Dayton will not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to the Service or these Terms, even if advised of the possibility of such damages.
13. Indemnification
You will defend, indemnify, and hold harmless Robert Dayton and LoyalServe from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your Customer Data; (b) your use of the Service in violation of these Terms or applicable law; or (c) your sworn statements, affidavits, or representations to courts, clients, or third parties.
14. Governing law & dispute resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. The parties consent to the exclusive jurisdiction of the state and federal courts located in Harris County, Texas for any dispute that is not subject to arbitration. Each party waives the right to a jury trial to the extent permitted by law.
15. Changes to these Terms
We may update these Terms from time to time. The current version is always posted on this site, and any changes take effect when posted, as reflected by the “Last updated” date at the top of this page. Your continued use of the Service after that date constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
16. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and any written order, constitute the entire agreement between you and us regarding the Service.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Severability. If any provision is held unenforceable, the remaining provisions will remain in effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Force majeure. Neither party is liable for failure or delay caused by events beyond its reasonable control.
